Title IV: ADMINISTRATIVE PROCEDURES AND DATA PROCESSING

The list of interpreter-translators provided for in the second paragraph of Article L. 141-3 is drawn up each year by the public prosecutor in each judicial court.It includes in an appendix the lists drawn up in the other judicial courts within the jurisdiction of the court of appeal.The list and its appendices are made available to the public at the registry of the judicial court.

Interpreters/translators registered on the list of legal experts for the court of appeal provided for in article 2 of law no. 71-498 of 29 June 1971 relating to legal experts are automatically registered on the list drawn up for the judicial court within whose jurisdiction their place of residence or place of exercise of their professional activity is situated, if they so request.

An individual who does not meet the condition set out in article R. 141-2 may only be entered or re-entered on the list if he or she meets the following conditions:1° Exercise his or her activity or be domiciled within the jurisdiction of the judicial court;2° Prove his or her competence by means of a diploma or experience acquired in the field of interpreting or translation;3° Not have been the…

A legal entity that does not meet the condition laid down in article R. 141-2 may only be registered on the list if it meets the following conditions:1° Its registered office is located within the jurisdiction of the judicial court;2° Its employees likely to perform an interpreting or translation assignment meet the conditions laid down in 2° and 3° of article R. 141-3;3° Its directors meet the requirements laid down…

The application for registration shall be accompanied by all relevant details, and in particular the following information:1° Language or dialect for which registration is requested;2° Titles or diplomas of the applicant, in particular in his speciality, literary, scientific or professional works he has accomplished, functions he has performed, activities he has exercised;3° Professional activities at the date of the application;4° Qualification of the applicant in his speciality;5° Means of telecommunication…

Physical or legal persons who have applied for or obtained their registration on the list shall inform the public prosecutor without delay of any change in their situation with regard to the conditions laid down in Articles R. 141-2, R. 141-3 and R. 141-4.

The public prosecutor examines applications made pursuant to articles R. 141-3 and R. 141-4.After obtaining the opinion of the president of the judicial court, he draws up the list during the first fortnight of January of each year.At the end of a five-year period, re-registration is decided under the same conditions and in the same forms and procedures as registration.

During the annual review of the list, the public prosecutor removes from the list any persons who no longer meet the conditions laid down in Articles R. 141-3 and R. 141-4 or removes from the list those who have not performed their duties under satisfactory conditions.

During the year, if the translator interpreter requests to be removed from the list or if such removal is made necessary by circumstances such as prolonged absence, illness or serious and permanent disability, the public prosecutor may decide to remove the interpreter from the list.During the course of the year, the public prosecutor may, in the event of serious grounds, order the temporary removal from the list.An extract of the…
