Article R142-4 of the French Code governing the entry and residence of foreign nationals and the right of asylum

The following shall have access to personal data and information recorded in the automated processing mentioned in article R. 142-1, by virtue of their duties and within the limits of their need to know:
1° Agents of the Ministry of Foreign Affairs and the Ministry responsible for immigration involved in the processing of visa applications, individually designated and specially authorised by the minister to whom they report;
2° Agents of prefectures, including in the context of the assessment procedure provided for in article R. 221-11 of the Social Action and Family Code, and those responsible for the application of regulations relating to the issue of residence permits, the processing of asylum applications and the preparation and implementation of removal measures, individually designated and specially authorised by the Prefect.
For the sole purpose of carrying out the checks mentioned in 9° of article R. 142-1, employees of social security bodies who have been individually designated and specially authorised by the directors of these bodies may consult data relating to the surname, first name, date and country of birth and photograph of the foreign national, as well as data relating to the issue of a visa, its date and period of validity and travel documents.

In order to prepare and implement deportation measures individually designated and specially authorised by the Prefect.

Article R142-4

Ont accès aux données à caractère personnel et aux informations enregistrées dans le traitement automatisé mentionné à l’article R. 142-1, à raison de leurs attributions et dans la limite du besoin d’en connaître :
1° Les agents du ministère des affaires étrangères et du ministère chargé de l’immigration participant à l’instruction des demandes de visa, individuellement désignés et spécialement habilités par le ministre dont ils relèvent ;
2° Les agents des préfectures, y compris dans le cadre de la procédure d’évaluation prévue par l’article R. 221-11 du code de l’action sociale et des familles, et ceux chargés de l’application de la réglementation relative à la délivrance des titres de séjour, au traitement des demandes d’asile et à la préparation et à la mise en œuvre des mesures d’éloignement individuellement désignés et spécialement habilités par le préfet.
A la seule fin d’effectuer les vérifications mentionnées au 9° de l’article R. 142-1, les agents des organismes de sécurité sociale individuellement désignés et spécialement habilités par les directeurs de ces organismes peuvent consulter les données relatives au nom, au prénom, à la date et au pays de naissance, à la photographie de l’étranger ainsi qu’à la délivrance d’un visa, à sa date, à sa durée de validité et aux document de voyage.
