Article R142-19 of the French Code governing the entry and residence of foreign nationals and the right of asylum

Personal data and information recorded in the processing mentioned in article R. 142-11 and in the electronic component provided for in articles R. 414-5 and R. 431-1 may be communicated, in particular for identification purposes, to agents of international cooperation bodies in the fight against illegal immigration under the conditions provided for by any commitment binding France to international bodies or foreign States; where these bodies and States do not belong to the European Union, the transfer of data is only possible if they ensure an adequate level of protection for the privacy, freedoms and fundamental rights of individuals with regard to personal data within the meaning of Chapter V of Regulation 2016/679 of 27 April 2016.

Les données à caractère personnel et informations enregistrées dans le traitement mentionné à l’article R. 142-11 et dans le composant électronique prévu aux articles R. 414-5 et R. 431-1 peuvent être communiquées, aux fins notamment d’identification, aux agents d’organismes de coopération internationale en matière de lutte contre l’immigration irrégulière dans les conditions prévues par tout engagement liant la France à des organismes internationaux ou à des Etats étrangers ; lorsque ces organismes et ces Etats n’appartiennent pas à l’Union européenne, le transfert des données n’est possible que s’ils assurent à la vie privée, aux libertés et aux droits fondamentaux des personnes à l’égard de données à caractère personnel un niveau de protection suffisant au sens du chapitre V du règlement 2016/679 du 27 avril 2016.
