Article R142-45 of the French Code governing the entry and residence of foreign nationals and the right of asylum

Have access to personal data and information recorded in the processing operations mentioned in article R. 142-43 :
1° The mayor of the commune of the place of accommodation or, in Paris, Lyon and Marseille, the arrondissement mayor, as well as individually authorised town hall staff with authority to examine requests for validation of reception certificates ;
2° The departmental prefect and, in Paris, the police prefect, as well as individually authorised prefecture staff with authority to investigate appeals relating to reception certificates and to exercise the prefect’s hierarchical authority insofar as this authority involves access to the same information as that held by mayors.

Ont accès aux données à caractère personnel et informations enregistrées dans les traitements mentionnés à l’article R. 142-43 :
1° Le maire de la commune du lieu d’hébergement ou, à Paris, Lyon et Marseille, le maire d’arrondissement, ainsi que les personnels de la mairie individuellement habilités ayant compétence pour instruire les demandes de validation des attestations d’accueil ;
2° Le préfet du département et, à Paris, le préfet de police, ainsi que les personnels de la préfecture individuellement habilités ayant compétence pour instruire les recours relatifs aux attestations d’accueil et pour l’exercice du pouvoir hiérarchique du préfet en tant que ce pouvoir implique l’accès aux mêmes informations que celles détenues par les maires.
