Article R142-46 of the French Code governing the entry and residence of foreign nationals and the right of asylum

The implementation of the processing mentioned in article R. 142-43 by the mayor of the municipality of the place of accommodation or, in Paris, Lyon and Marseille, by the district mayor is subject to the prior submission to the Commission nationale de l’informatique et des libertés, pursuant to IV of article 31 of law no. 78-17 of 6 January 1978, a compliance undertaking referring to this article and specifying the exact location of the automated processing, the procedures for exercising the right of access and the mayor’s specific undertaking that data security and confidentiality measures have been implemented and the procedures for the individual authorisation of municipal staff with access to the file.

La mise en œuvre des traitements mentionnés à l’article R. 142-43 par le maire de la commune du lieu d’hébergement ou, à Paris, Lyon et Marseille, par le maire d’arrondissement est subordonnée à l’envoi préalable à la Commission nationale de l’informatique et des libertés, en application du IV de l’article 31 de la loi n° 78-17 du 6 janvier 1978, d’un engagement de conformité faisant référence au présent article et précisant le lieu exact d’implantation du traitement automatisé, les modalités d’exercice du droit d’accès ainsi que l’engagement spécifique du maire qu’ont été mises en œuvre des mesures de sécurité et de confidentialité des données et des modalités d’habilitation individuelle des personnels communaux ayant accès au fichier.
