Article R1411-58-10 of the French Public Health Code

The elections of staff representatives to the Boards of Directors mentioned in this section are organised in accordance with the following procedures, subject to the provisions of articles R. 1411-58-11 and R. 1411-58-12:

1° In the event of a nominal or multi-member ballot: for each staff representative seat, the candidate and his/her alternate shall be of different genders. If a trade union organisation presents several candidates, the difference between the number of women and the number of men standing as titular candidates may not be greater than one;

2° In the event of a list ballot: each list is made up alternately of one titular candidate of each gender. On each of the lists, the difference between the number of titular candidates of each sex may not be greater than one. Each candidate and his/her alternate shall be of a different sex.

Les élections des représentants du personnel au sein des conseils d’administration mentionnés à la présente section sont organisées selon les modalités suivantes, sous réserve des dispositions des articles R. 1411-58-11 et R. 1411-58-12 :

1° En cas de scrutin nominal ou plurinominal : pour chaque siège de représentant du personnel, le candidat et son suppléant sont de sexe différent. Si une organisation syndicale présente plusieurs candidats, l’écart entre le nombre de femmes et le nombre d’hommes se portant candidats en tant que titulaires ne peut être supérieur à un ;

2° En cas de scrutin de liste : chaque liste est composée alternativement d’un candidat titulaire de chaque sexe. Sur chacune des listes, l’écart entre le nombre des candidats titulaires de chaque sexe ne peut être supérieur à un. Chaque candidat et son suppléant sont de sexe différent.
