Article R1411-58-13 of the French Public Health Code

At the time of renewal of each of the Boards of Directors mentioned in Article L. 1411-5-2, the persons called upon to take part in an appointment, who wish to renew the term of office of one or more of their outgoing members, send their proposal to the Minister for Health no later than four months before the end of the term of office of the member being renewed.

If it appears that the proposed renewals sent to the Minister for Health do not ensure compliance with the parity rule provided for in the first paragraph of article L. 1411-5-2 for the entire body, a draw is organised by this Minister to designate the person or persons mentioned in this article who must give up this renewal.

These persons may be present or represented at the draw.

Lors du renouvellement de chacun des conseils d’administration mentionnés à l’article L. 1411-5-2, les personnes appelées à prendre part à une désignation, qui souhaitent reconduire le mandat d’un ou plusieurs de leurs membres sortants, transmettent leur proposition au ministre chargé de la santé au plus tard quatre mois avant la fin du mandat du membre faisant l’objet du renouvellement.


S’il apparaît que les propositions de reconduction de mandats transmises au ministre chargé de la santé ne permettent pas d’assurer le respect de la règle de parité prévue au premier alinéa de l’article L. 1411-5-2 sur la totalité de l’instance, un tirage au sort est organisé par ce ministre pour désigner la ou les personnes mentionnées à cet article qui doivent renoncer à cette reconduction.


Ces personnes peuvent assister ou se faire représenter lors du tirage au sort.
