Article R1411-6 of the French General Code of Local Authorities

A prefect who refers a public service delegation agreement to the regional audit chamber, pursuant to article L. 1411-18, attach to this referral, in addition to the full text of the act, all documents and information useful for its examination and relating to its award.

The provisions of the articles R. 244-1, R. 263-13 and R. 263-41 of the Financial Jurisdictions Code and those of articles R. 1612-8, R. 1612-12 and R. 1612-13, relating to the control of budgetary acts, are applicable.

The Chamber issues a reasoned opinion in which it examines, in particular, the arrangements for entering into the agreement, the general economics of the agreement and its financial impact on the situation of the local authority or public establishment concerned.

This opinion is sent to the Prefect and to the local authority or public body concerned. It may be communicated as soon as the first meeting of the deliberative assembly following its receipt by the local authority or public establishment concerned has taken place.

This opinion is notified to the Prefect and the local authority or public establishment concerned.

Le préfet qui saisit la chambre régionale des comptes d’une convention relative à une délégation de service public, en application de l’article L. 1411-18, joint à cette saisine, outre le texte intégral de l’acte, tous documents et renseignements utiles à son examen et relatifs à sa passation.

Les dispositions des articles R. 244-1, R. 263-13 et R. 263-41 du code des juridictions financières ainsi que celles des articles R. 1612-8, R. 1612-12 et R. 1612-13, relatives au contrôle des actes budgétaires, sont applicables.

La chambre rend un avis motivé dans lequel elle examine notamment les modalités de passation, l’économie générale de la convention ainsi que son incidence financière sur la situation de la collectivité ou de l’établissement public concerné.

Cet avis est notifié au préfet ainsi qu’à la collectivité ou à l’établissement public intéressé. Il est communicable dès qu’a eu lieu la première réunion de l’assemblée délibérante suivant sa réception par la collectivité ou l’établissement public concerné.
