Article R1412-3 of the French Public Health Code

Half of the Committee’s membership is renewed every eighteen months.

In the event of the death, resignation or termination for any other reason of a Committee member during his term of office, he shall be replaced under the same conditions as his appointment and for the remainder of his term of office.

In the event of the prolonged absence of a Committee member, a panel consisting of the Committee Chairman, the Vice-Chairman and the Chairman of the Technical Section may declare the position vacant; the member is replaced under the conditions laid down in article L. 1412-2 and for the remainder of the term of office.

The first term of office of a Committee member called upon to replace another during the course of his/her term of office is not taken into account for the purposes of limiting the possibility of renewal provided for in Article L. 1412-2 if he/she has held this replacement position for less than eighteen months.

Le comité est renouvelé par moitié tous les dix-huit mois.

En cas de décès, de démission ou de cessation de fonctions pour toute autre cause d’un membre du comité en cours de mandat, son remplacement s’effectue dans les mêmes conditions que sa nomination et pour la durée du mandat restant à courir.

En cas d’absence prolongée d’un membre du comité, un collège composé du président du comité, du vice-président et du président de la section technique peut déclarer le poste vacant ; ce membre est remplacé dans les conditions prévues à l’article L. 1412-2 et pour la durée du mandat restant à courir.

Le premier mandat d’un membre du comité appelé à en remplacer un autre en cours de mandat n’est pas pris en compte pour la limitation de la possibilité de renouvellement prévue à l’article L. 1412-2 s’il a occupé ces fonctions de remplacement pendant moins de dix-huit mois.
