Article R1413-28 of the French Public Health Code

Referrals to the Agency by organisations represented on the Board of Directors in application of the first paragraph of article L. 1413-5 must be sent by the head of the organisation, or by its representative expressly designated by proxy, to the Director General of the Agency. It must be duly substantiated and, where appropriate, accompanied by any supporting documents. In the event of a joint referral by several bodies, a single referral may be sent, countersigned by the various petitioners.

The Director General acknowledges receipt of the referral and sends copies to the ministries concerned.

He decides, in accordance with the procedure adopted by the Board of Directors, what action to take, taking into account the Agency’s resources and priorities. It reports to the Board of Directors and informs the applicant, specifying, where appropriate, the time required for its examination.

The opinion issued by the Agency is sent to the applicant. It is sent to the Minister for Health and the other Ministers concerned and made public.

La saisine de l’agence, effectuée par les organismes représentés au conseil d’administration en application du premier alinéa de l’article L. 1413-5, doit être adressée par le dirigeant de l’organisme, ou par son représentant expressément désigné par voie de procuration, au directeur général de l’agence. Elle doit être dûment motivée et, le cas échéant, accompagnée de toutes pièces justificatives. En cas de saisine conjointe par plusieurs organismes, il est possible d’adresser une saisine unique contresignée par les différents pétitionnaires.

Le directeur général accuse réception de cette saisine et en adresse copie aux ministères concernés.

Il décide, conformément à la procédure adoptée par le conseil d’administration, de la suite à donner, en tenant compte notamment des moyens et des priorités de l’agence. Il en rend compte au conseil d’administration et en informe le demandeur, en précisant, le cas échéant, les délais nécessaires pour son examen.

L’avis émis par l’agence est adressé à l’auteur de la saisine. Il est communiqué au ministre chargé de la santé ainsi qu’aux autres ministres concernés et rendu public.
