Referrals to the Agency by organisations represented on the Board of Directors in application of the first paragraph of article L. 1413-5 must be sent by the head of the organisation, or by its representative expressly designated by proxy, to the Director General of the Agency. It must be duly substantiated and, where appropriate, accompanied by any supporting documents. In the event of a joint referral by several bodies, a single referral may be sent, countersigned by the various petitioners.
The Director General acknowledges receipt of the referral and sends copies to the ministries concerned.
He decides, in accordance with the procedure adopted by the Board of Directors, what action to take, taking into account the Agency’s resources and priorities. It reports to the Board of Directors and informs the applicant, specifying, where appropriate, the time required for its examination.
The opinion issued by the Agency is sent to the applicant. It is sent to the Minister for Health and the other Ministers concerned and made public.
