Article R1422-2 of the French Labour Code

The decrees establishing the industrial tribunal provided for in article L. 1422-3 determine the seat and jurisdiction of the tribunal and the date of appointment of the councillors.

They are issued after consultation or opinion of :

1° The departmental council and the municipal council ;

2° The industrial tribunal(s) concerned;

3° The first president of the court of appeal;

4° Representative employers’ and employees’ organisations at national level;

5° The consular chambers.

Article R1422-2

Les décrets d’institution du conseil de prud’hommes prévus à l’article L. 1422-3 fixent le siège et le ressort du conseil ainsi que la date de la désignation des conseillers.

Ils sont pris après consultation ou avis :

1° Du conseil départemental et du conseil municipal ;

2° Du ou des conseils de prud’hommes intéressés ;

3° Du premier président de la cour d’appel ;

4° Des organisations d’employeurs et de salariés représentatives au niveau national ;

5° Des chambres consulaires.
