Article R1423-12 of the French Labour Code

After two rounds of voting in which none of the candidates has obtained an absolute majority of the members present, the Chairman or Vice-Chairman is elected in the third round by a relative majority.
In the event of a tie in the third ballot, the longest-serving councillor is elected. If the two candidates have served the same length of time, the older is elected. The same applies if a new industrial tribunal is set up.

Après deux tours de scrutin sans qu’aucun des candidats n’ait obtenu la majorité absolue des membres présents, le président ou le vice-président est, au troisième tour, élu à la majorité relative.
Lorsqu’il existe un partage égal des voix au troisième tour, le conseiller le plus ancien en fonction est élu. Lorsque les deux candidats ont un temps de service égal, le plus âgé est élu. Il en est de même dans le cas de création d’un conseil de prud’hommes.
