Article R1425-10 of the French General Code of Local Authorities

The term of office of a member of the commission ends when he loses the capacity in which he was called to sit.

In the case of a departmental representative, the departmental council elects a replacement.

In the case of a representative of the municipalities and public establishments for inter-municipal cooperation, he is replaced by the first non-elected candidate on the same list. Failing this, a by-election is held in a single-round uninominal ballot.

Le mandat d’un membre de la commission prend fin lorsqu’il perd la qualité au titre de laquelle il a été appelé à siéger.

Lorsqu’il s’agit d’un représentant du département, le conseil départemental élit son remplaçant.

Lorsqu’il s’agit d’un représentant des communes et des établissements publics de coopération intercommunale, il est remplacé par le premier candidat non élu de la même liste. A défaut, il est procédé à une élection partielle au scrutin uninominal à un tour.
