Article R1425-24 of the French General Code of Local Authorities

The national commission draws up a proposal for the settlement of transfers. This proposal is sent by the prefect to the department, the commune or public establishment for inter-communal cooperation and the departmental fire and rescue service concerned. The parties may submit any comments to the prefect in writing within two months of the date of transmission of the proposal.

For staff transfers, the territorial employment authorities convene the competent joint bodies within the same timeframe to obtain their opinion on the proposed settlement. This opinion is communicated to the prefect.

The prefect forwards these opinions and observations to the chairman of the national commission.

La commission nationale établit une proposition de règlement des transferts. Cette proposition est transmise par le préfet au département, à la commune ou à l’établissement public de coopération intercommunale et au service départemental d’incendie et de secours concernés. Les parties peuvent formuler, par écrit, toutes observations au préfet dans un délai de deux mois à compter de la date de transmission de la proposition.

Pour les transferts de personnels, les autorités territoriales d’emploi réunissent dans le même délai les instances paritaires compétentes pour recueillir leur avis sur la proposition de règlement. Cet avis est communiqué au préfet.

Le préfet transmet ces avis et ces observations au président de la commission nationale.
