Article R143-4 of the French Insurance Code

The Supervisory Committee issues an opinion on the report provided for in the last paragraph of article L. 143-2-2, when it is drawn up and whenever it is amended.

When the Supervisory Committee set up for a contract wishes to hear the statutory auditor(s) in application of article L. 143-2, the information provided by the statutory auditor(s) is that relating to the auxiliary allocation accounts in which the operations of this contract are recorded, and relates to the annual accounts produced by these accounts even if they include several supplementary occupational pension contracts.

Le comité de surveillance émet un avis sur le rapport prévu au dernier alinéa de l’article L. 143-2-2, lors de son établissement et à chaque modification de ce rapport.

Lorsque le comité de surveillance institué au niveau d’un contrat souhaite entendre le ou les commissaires aux comptes en application de l’article L. 143-2, les informations communiquées par ce ou ces derniers sont celles relatives à la comptabilité auxiliaire d’affectation dans laquelle sont enregistrées les opérations de ce contrat, et portent sur les comptes annuels issus de cette comptabilité même si celle-ci regroupe plusieurs contrats de retraite professionnelle supplémentaire.
