Article R1431-20 of the French General Code of Local Authorities

I. – The public establishment for cultural or environmental cooperation is dissolved at the request of all its members. The dissolution is pronounced by order of the State representative. It takes effect on 31 December of the year in which it was requested.

II. – When, as a result of the withdrawal of one or more of its members, the establishment now comprises only one public entity, the Prefect shall order its dissolution, which shall take effect on 31 December of the year in which it occurs.

III. – When serious and persistent difficulties in the operation of the board of directors make it impossible for the establishment to fulfil its missions, the representative of the State may request that the establishment be automatically dissolved, which shall be pronounced by a decree issued after receiving the assent of the Conseil d’Etat.

I. – L’établissement public de coopération culturelle ou environnementale est dissous à la demande de l’ensemble de ses membres. La dissolution est prononcée par arrêté du représentant de l’Etat. Elle prend effet au 31 décembre de l’année au cours de laquelle elle a été demandée.

II. – Lorsque, à la suite du retrait d’un ou de plusieurs de ses membres, l’établissement ne comprend plus qu’une personne publique, le préfet en prononce la dissolution qui prend effet au 31 décembre de l’année au cours de laquelle elle intervient.

III. – Lorsque des difficultés graves et persistantes dans le fonctionnement du conseil d’administration mettent l’établissement dans l’impossibilité d’assurer ses missions, le représentant de l’Etat peut demander la dissolution d’office qui est prononcée par décret pris sur avis conforme du Conseil d’Etat.
