Article R1442-22-10 of the French Labour Code

The councillor in question may be assisted by one of his peers, by a lawyer admitted to the Conseil d’Etat and the Cour de Cassation or by a lawyer registered with a bar association.

The file on the proceedings is made available to the party concerned and his counsel at least forty-eight hours before each committee meeting or each hearing by the rapporteur or his delegate. At any time during the proceedings, the employee representative in question may submit any documents he or she deems useful and lodge statements in his or her defence.

Le conseiller prud’homme mis en cause peut se faire assister par l’un de ses pairs, par un avocat au Conseil d’État et à la Cour de cassation ou par un avocat inscrit à un barreau.


Le dossier de la procédure est mis à la disposition de l’intéressé et de son conseil quarante-huit heures au moins avant chaque séance de la commission ou chaque audition par le rapporteur ou son délégué. Le conseiller prud’homme mis en cause peut à tout moment de la procédure verser aux débats les pièces qu’il estime utiles et déposer des mémoires en défense.
