Article R15-2-2 of the French Code of Criminal Procedure

The request for authorisation is sent to the public prosecutor at the court of appeal in whose jurisdiction the reservist’s first posting is located. Depending on the unit or service of this first posting of the reservist the request is forwarded by the commander of the gendarmerie region, the commander of the departmental gendarmerie group, the commander of the gendarmerie in the overseas departments and collectivities and in New Caledonia, the commander of a gendarmerie formation directly attached to the central administration or the head of service or unit commander with national competence.

La demande d’habilitation est adressée au procureur général près la cour d’appel dans le ressort de laquelle intervient la première affectation du réserviste. Suivant l’unité ou le service de cette première affectation du réserviste la demande est transmise par le commandant de région de gendarmerie, le commandant de groupement de la gendarmerie départementale, le commandant de la gendarmerie dans les départements et les collectivités d’outre-mer et en Nouvelle-Calédonie, le commandant d’une formation de gendarmerie directement rattachée à l’administration centrale ou le chef de service ou commandant d’unité à compétence nationale.
