The technical procedures for interrogating and transmitting information are specified in a protocol signed by the Minister of Justice and, as appropriate, the Minister of the Interior or the Minister responsible for the Budget with each body or legal entity covered by the provisions of Article R. 15-33-68.
This protocol specifies in particular:
1° The computer system(s) or automated processing of personal data concerned;
2° The nature of the personal data likely to be made available;
3° The terms and conditions under which the body or legal entity allows the judicial police officer to consult the information requested and to transfer it to his department electronically ;
4° The conditions and procedures for securing the electronic link so as to guarantee the origin, destination, integrity and confidentiality of the data when the requested information is routed to the requesting service;
5° The procedures for monitoring requests and consultations, including the identification of the judicial police officer ;
6° Guarantees limiting consultation to the information requested and preventing any access to information protected by a secret provided for by law, in particular by medical secrecy, except in cases where the law provides that such secrecy is not enforceable against the judicial authorities.
The protocol shall be brought to the attention of all judicial police officers in judicial police departments and units, as well as customs officers covered by Article 28-1, who have been expressly authorised to make such requests.
