Article R15-41 of the French Code of Criminal Procedure

The civil party is required, pursuant to articles 88 and 88-1, to deposit at the court registry, unless exempted, within the time limit set by the investigating judge, on pain of inadmissibility, a sum to guarantee payment of the civil fine that may be ordered against him or her on the basis of the Article 91 of the Code of Criminal Procedure.

The sum deposited is returned to the civil party on simple receipt when the action based on this provision is time-barred or has resulted in a decision that has become final finding that the civil party’s constitution was neither abusive nor dilatory.

In the event of a civil fine being imposed, the sum deposited shall be used to pay the fine.

Article R15-41

La partie civile est tenue, en application des articles 88 et 88-1, de consigner au greffe sauf dispense, dans le délai imparti par le juge d’instruction, sous peine d’irrecevabilité, une somme en vue de garantir le paiement de l’amende civile pouvant être prononcée à son encontre sur le fondement de l’article 91 du code de procédure pénale.

La somme consignée est remise à la partie civile sur simple récépissé lorsque l’action fondée sur cette disposition est prescrite ou a abouti à une décision devenue définitive constatant que la constitution de partie civile n’était ni abusive ni dilatoire.

En cas de condamnation à une amende civile, la somme consignée est employée au paiement de celle-ci.
