Article R152-2 of the French Code governing the entry and residence of foreign nationals and the right of asylum

For the application of this book to Saint-Barthélemy:
1° The references to the departmental council are replaced by the reference to the territorial council of Saint-Barthélemy;
2° The references to the mayor are replaced by the reference to the president of the territorial council of Saint-Barthélemy;
3° The references to the prefect are replaced by the reference to the representative of the State in the collectivity and the reference to the sub-prefectures is deleted;
4° The references to the regional director of customs are replaced by the reference to the regional director of customs of Guadeloupe ;
5° References to the external borders of the States party to the Schengen Agreement signed on 19 June 1990 are deleted;
6° References to Regulation (EC) No 390-2009 of the European Parliament and of the Council of 23 April 2009 are deleted;
7° The references to the commander of the gendarmerie group are replaced by the reference to the commander of the Guadeloupe gendarmerie;
8° The references to the commanders of the departmental gendarmerie group are replaced by the reference to the commanders of the territorial formation of the national gendarmerie based in the community;
9° In Article R. 140-1, the references to articles R. 142-33 to R. 142-40 are deleted;
10° In article R. 142-16:
a) the references to the regional directorates for companies, competition, consumption, labour and employment and to the regional director are replaced by the reference to the Guadeloupe directorate for companies, competition, consumption, labour and employment and to the director;
b) in 7°, after the words: “authorised customs agents” and the words: “authorised tax agents”, the words: “reporting to the State”;
11° The references to Regulation (EU) 2016/679 of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC are replaced by the reference to the rules in force in mainland France under Regulation (EU) 2016/679 of 27 April 2016.

Pour l’application du présent livre à Saint-Barthélemy :
1° Les références au conseil départemental sont remplacées par la référence au conseil territorial de Saint-Barthélemy ;
2° Les références au maire sont remplacées par la référence au président du conseil territorial de Saint-Barthélemy ;
3° Les références au préfet sont remplacées par la référence au représentant de l’Etat dans la collectivité et la référence aux sous-préfectures est supprimée ;
4° Les références au directeur régional des douanes sont remplacées par la référence au directeur régional des douanes de Guadeloupe ;
5° Les références aux frontières extérieures des Etats parties à la convention signée à Schengen le 19 juin 1990 sont supprimées ;
6° Les références au règlement (CE) n° 390-2009 du Parlement européen et du Conseil du 23 avril 2009 sont supprimées ;
7° Les références au commandant du groupement de gendarmerie sont remplacées par la référence au commandant de la gendarmerie de la Guadeloupe ;
8° Les références aux commandants de groupement de gendarmerie départementale sont remplacées par la référence aux commandants de la formation territoriale de la gendarmerie nationale implantée dans la collectivité ;
9° A l’article R. 140-1, les références aux articles R. 142-33 à R. 142-40 sont supprimées ;
10° A l’article R. 142-16 :
a) les références aux directions régionales des entreprises, de la concurrence, de la consommation, du travail et de l’emploi et au directeur régional sont remplacées par la référence à la direction des entreprises, de la concurrence, de la consommation, du travail et de l’emploi de Guadeloupe et au directeur ;
b) au 7°, après les mots : ” agents des douanes habilités ” et les mots : ” agents des services fiscaux habilités “, sont ajoutés les mots : ” relevant de l’Etat ” ;
11° Les références au règlement (UE) 2016/679 du 27 avril 2016 relatif à la protection à la protection des personnes physiques à l’égard des traitements des données à caractère personnel et à la libre circulation de ces données, et abrogeant la directive 95/46/ CE sont remplacées par la référence aux règles en vigueur en métropole en vertu du règlement (UE) 2016/679 du 27 avril 2016.
