I.-Section 1 of Chapter I of Title III of Book I of this Part is applicable in New Caledonia and French Polynesia, as amended by Decrees no. 2008-321 of 4 April 2008, no. 2010-344 of 31 March 2010 and no. 2013-527 of 20 June 2013, with the exception of articles R. 1131-3, R. 1131-7 to R. 1131-8, R. 1131-13 to R. 1131-18 and R. 1131-20-5 and subject to the adaptations provided for in II.
II.-A.-In article R. 1131-2, the last sentence of 3° is deleted.A.- In article R. 1131-2, the last sentence of 3° is deleted.
B.- In article R. 1131-4, for its application in New Caledonia:
1° The first sentence of the last paragraph is deleted;
2° In the second sentence of the last paragraph, the words: “under guardianship” are replaced by the word: “protected”.
C.-In article R. 1131-5:
1° In the second paragraph, the words: “clinical and genetic skills” are replaced by the words: “skills to ensure appropriate care” and the last sentence is deleted;
2° In the third paragraph, for its application in New Caledonia, the words: “under guardianship” are replaced by the word: “protected”;
3° In the fourth paragraph, the last sentence is replaced by the sentence: “This certificate is given to the practitioner responsible for carrying out the genetic characteristics tests, and a copy of this certificate is placed in the medical file of the person concerned. “
D.-In article R. 1131-6:
1° In the first paragraph, the words: “and working in one of the establishments or organisations mentioned in article R. 1131-13” are deleted;
2° The second paragraph is deleted.
E.-In the first paragraph of articles R. 1131-9 and R. 1131-11, the words: “mentioned in article R. 1131-6” are deleted.
F.- In the last paragraph of articles R. 1131-9 and R. 1131-11, the words: “mentioned in article R. 1131-6” are deleted.In the last paragraph of articles R. 1131-10 and R. 1131-11, the words: “the competent regional health agency, as well as the establishment or organisation holding the authorisation referred to in article R. 1131-13 within which the practitioner works” are replaced by the words: “the organisation where he works and the competent authority in New Caledonia or French Polynesia”.
G.-In article R. 1131-19, the first paragraph is replaced by the following provisions:
“The report on analyses to determine the genetic characteristics of a person or their identification by genetic fingerprinting for medical purposes is commented on and signed by the practitioner in charge of the analyses.
H.-In article R. 1131-20, the words: “by the prescribing doctor” and the words: “mentioned in article R. 1131-13” are deleted.
I.-In article R. 1131-20-1, the words: “and in accordance with the good practices defined by article R. 1131-20-5” are deleted.
J.-In article R. 1131-20-2, the words: “and in accordance with the good practices defined by article R. 1131-20-5” are deleted.In article R. 1131-20-3:
1° In the first paragraph, the words: “the head of the procreation medical assistance centre” are replaced by the words: “the procreation medical assistance doctor”;
2° The second paragraph is replaced by the following provisions:
“Where the person consents, he/she shall give written authorisation to the prescribing doctor, who shall certify this, to inform the medically assisted procreation doctor. He/she shall provide the doctor with his/her contact details and those of the place where the gamete donation was made or where the embryos are or were stored. “
