Article R1613-10 of the French General Code of Local Authorities

As an exception to the provisions of article R. 1613-9, the amount of the State grant may, by way of exception, bring the amount of direct public aid up to 100% of the pre-tax amount of the damage caused by the same event.

An advance may be paid when the operation begins. Its amount may represent up to 20% of the estimated amount of the grant. This amount may be increased to 30% for urgent work necessary for the mobility or safety of people, particularly with regard to work to restore the flow capacity of watercourses mentioned in the first paragraph of article R. 1613-5.

The benefit of these provisions is assessed on a case-by-case basis by the State representative, taking into account the financial capacity of the local authority or group of local authorities and the extent of the damage.

Par dérogation aux dispositions de l’article R. 1613-9, le montant de la subvention de l’Etat peut, à titre exceptionnel, porter le montant des aides publiques directes jusqu’à 100 % du montant hors taxes des dégâts causés par un même événement.

Une avance peut être versée lors du commencement d’exécution de l’opération. Son montant peut représenter jusqu’à 20 % du montant prévisionnel de la subvention. Ce montant peut être porté jusqu’à 30 % pour des travaux urgents nécessaires à la mobilité ou à la sécurité des personnes, notamment en ce qui concerne les travaux de restauration des capacités d’écoulement des cours d’eaux mentionnés au premier alinéa de l’article R. 1613-5.

Le bénéfice de ces dispositions est apprécié au cas par cas par le représentant de l’Etat en prenant en compte la capacité financière de la collectivité territoriale ou du groupement de collectivités territoriales et l’importance des dégâts.
