Article R1613-9 of the French General Code of Local Authorities

When the total amount of subsidies likely to be granted has been determined, the distribution of subsidies between local authorities and groupings in the same département is established on the basis of maximum subsidy rates applicable as follows:

1° A rate of 80% when the amount of damage suffered is greater than 50% of their total budget;

2° A rate of 40% when the amount of damage suffered is between 10% and 50% of their total budget;

3° A rate of 30% when the amount of damage suffered is less than 10% of the total budget ;

For the application of this article, the amount of the total budget taken into account corresponds to the sum of actual operating expenditure and actual investment expenditure as recorded in the latest available administrative accounts.

Lorsque le montant total des subventions susceptibles d’être accordées a été déterminé, la répartition des subventions entre collectivités et groupements d’un même département est établie sur la base de taux maximums de subvention applicables comme suit :

1° Un taux de 80 % lorsque le montant des dégâts subis est supérieur à 50 % de leur budget total ;

2° Un taux de 40 % lorsque le montant des dégâts subis est compris entre 10 % et 50 % de leur budget total ;

3° Un taux de 30 % lorsque le montant des dégâts subis est inférieur à 10 % du budget total ;

Pour l’application du présent article, le montant du budget total pris en compte correspond à la somme des dépenses réelles de fonctionnement et des dépenses réelles d’investissement telles que constatées dans les derniers comptes administratifs disponibles.
