Article R1613-18 of the French General Code of Local Authorities

The State representative decides on the subsidy rate for each repair operation, based on the maximum subsidy rates provided for in article R. 1613-9 and the assessment of eligible damage. If the sum of grants that may be awarded to local authorities or groupings exceeds the total amount mentioned in article R. 1613-17, the State representative sets the subsidies within the limit of this amount and according to the size of the local authority or grouping, its financial capacity and the extent of the damage.

In the opposite case, the State representative sets the amount of the subsidies by applying the maximum rates mentioned in article R. 1613-9 to the amount of the damage.

The beneficiary local authorities and groupings are notified of the subsidies by order of the State representative.

Article R1613-18

Le représentant de l’Etat décide du taux de subvention pour chaque opération de réparation, en fonction des taux maximums de subvention prévus à l’article R. 1613-9 et de l’évaluation des dégâts éligibles. Si la somme des subventions pouvant être attribuées aux collectivités territoriales ou aux groupements excède le montant total mentionné à l’article R. 1613-17, le représentant de l’Etat fixe les subventions dans la limite de ce montant et en fonction de la taille de la collectivité ou du groupement, de sa capacité financière et de l’importance des dégâts.

Dans le cas inverse, le représentant de l’Etat fixe le montant des subventions en appliquant les taux maximums mentionnés à l’article R. 1613-9 au montant des dégâts.

Les subventions sont notifiées aux collectivités territoriales et groupements bénéficiaires par arrêté du représentant de l’Etat.
