The State representative assesses the amount of damage whose repair is eligible for the allocation defined in article L. 1613-6.
After making an initial assessment of the damage, the State representative may request, within seventy-five days of the event, the support of a mission from the General Inspectorate for the Environment and Sustainable Development. This mission is compulsory when the total estimated amount of damage exceeds one million euros excluding taxes or when the climatic or geological event causing the damage has affected several départements. The mission submits to the State representative its assessment of the amount of damage, the complete list of local authorities or groupings whose applications it is proposed to accept and a proposal on the total amount of subsidies likely to be granted to them within the same department, within forty-five days of the referral of the aforementioned inspection by the State representative.
When the total amount of estimated damage exceeds 6 million euros excluding taxes or when the extent of the damage and the difficulty of the assessments justify it, the minister responsible for local authorities may request the support of an inspection mission. The mission submits its assessment of the damage, the full list of local authorities or groupings whose applications it is proposed to accept and a proposal on the total amount of subsidies likely to be granted to them within the same department, to the minister responsible for local authorities and the minister responsible for the budget, within a period of time set by the minister responsible for local authorities.
When the amount of damage suffered by a local authority is less than 1% of its total budget, as defined in article R. 1613-9, this amount is excluded from the eligible base. The application of this provision is assessed by the representative of the State on the basis of local circumstances, the extent of the damage and the proposals of the missions mentioned in the previous paragraphs.
