Article R167 of the French Code of Criminal Procedure

The public prosecutor or the public prosecutor may, however, object, by a specially reasoned decision, to the issue of a copy of a decision mentioned in 2° of Article R. 166:

1° In the case of a conviction erased by amnesty, rehabilitation or review;

> In the case of a conviction erased by amnesty, rehabilitation or review;

In the case of a conviction erased by amnesty, rehabilitation or review
2° If the conviction is time-barred;

> or
3° If it appears that the copy is requested with the intention of causing harm;

The public prosecutor or the public prosecutor may also decide that the copy may only be issued after the elements or reasons for the decision that do not need to be disclosed have been blacked out.

Article R167

Le procureur de la République ou le procureur général peut toutefois s’opposer, par décision spécialement motivée, à la délivrance de la copie d’une décision mentionnée au 2° de l’article R. 166 :


1° S’il s’agit d’une condamnation effacée par l’amnistie, la réhabilitation ou la révision ;


2° S’il s’agit d’une condamnation prescrite ;


3° S’il apparaît que la copie est demandée dans l’intention de nuire.


Le procureur de la République ou le procureur général peut également décider que la copie ne pourra être délivrée qu’après l’occultation des éléments ou des motifs de la décision qui n’ont pas à être divulgués.
