Article R211-46 of the French Cinema and Moving Image Code

The author of the request determines the classification measure mentioned in article R. 211-12 that accompanies the work or document’s endorsement and, where applicable, the warning mentioned in article R. 211-13 that accompanies it.

When the classification measure and, where applicable, the warning attached to it clearly do not meet the requirements mentioned in II of article R. 211-12, the Minister responsible for culture refers the matter to the committee for the classification of cinematographic works mentioned in article R. 211-29 for an opinion, which meets under the conditions set out in articles R. 211-36 to D. 211-44.

In the light of this opinion, the Minister determines the classification measure and, where applicable, the warning attached to it.

L’auteur de la demande détermine la mesure de classification mentionnée à l’article R. 211-12 qui accompagne le visa de l’œuvre ou du document et, le cas échéant, l’avertissement mentionné à l’article R. 211-13 dont elle est assortie.

Lorsque la mesure de classification et, le cas échéant, l’avertissement dont elle est assortie ne répondent manifestement pas aux exigences mentionnées au II de l’article R. 211-12, le ministre chargé de la culture saisit pour avis la commission de classification des œuvres cinématographiques mentionnée à l’article R. 211-29 qui se réunit dans les conditions prévues aux articles R. 211-36 à D. 211-44.

Au vu de cet avis, le ministre détermine la mesure de classification et le cas échéant l’avertissement dont elle est assortie.
