Article R212-3 of the French Cinema and Moving Image Code

The authorisation to operate a cinema in the form of a touring activity is granted on the basis of the geographical complementarity of the cinematographic offer presented by the application with regard to the cinemas of the cinematographic establishments whose operation is authorised by virtue of article R. 212-1.
To assess this complementarity, the Chairman of the Centre national du cinéma et de l’image animée refers to the respective catchment areas of the applicant’s activity and these cinemas. The definition of the catchment area is that of the cinematographic area of influence within the meaning of article R. 212-7-1.
The Chairman of the Centre national du cinéma et de l’image animée may ask the Regional Director of Cultural Affairs to consult experts in cinema exhibition and distribution and interested parties beforehand.

Article R212-3

L’autorisation d’exploiter un établissement de spectacles cinématographiques sous la forme d’une activité itinérante est accordée en fonction de la complémentarité géographique de l’offre de spectacles cinématographiques que présente la demande au regard des salles des établissements de spectacles cinématographiques dont l’exploitation est autorisée en vertu de l’article R. 212-1.
Pour apprécier cette complémentarité, le président du Centre national du cinéma et de l’image animée se réfère aux zones de chalandise respectives de l’activité du demandeur et de ces salles. La définition de la zone de chalandise est celle de la zone d’influence cinématographique au sens de l’article R. 212-7-1.
Le président du Centre national du cinéma et de l’image animée peut demander au directeur régional des affaires culturelles de procéder à une consultation préalable d’experts en matière d’exploitation et de distribution cinématographiques et des personnes intéressées.
