Article R212-36 of the French Cinema and Moving Image Code

When the operator of a cinema within the scope of 2° of article R. 212-30 has not sent its proposals within two months of notification or where these proposals do not comply with the objectives listed in Article R. 212-31, the Chairman of the Centre national du cinéma et de l’image animée will give the applicant formal notice to submit proposed programming commitments within one month.
If, on expiry of the period stipulated in the previous paragraph, the exhibitor has not submitted any proposals or if the proposals submitted do not comply with the objectives listed in article R. 212-31, the Chairman of the Centre national du cinéma et de l’image animée will determine the exhibitor’s programming commitments, after consulting the cinema ombudsman, in accordance with these objectives.

Lorsque l’exploitant d’un établissement de spectacles cinématographiques entrant dans le champ du 2° de l’article R. 212-30 n’a pas adressé ses propositions dans les deux mois suivant la notification ou lorsque ces propositions ne sont pas conformes aux objectifs énumérés à l’article R. 212-31, le président du Centre national du cinéma et de l’image animée le met en demeure de présenter des propositions d’engagements de programmation dans le délai d’un mois.
Si, à l’expiration du délai prévu à l’alinéa précédent, l’exploitant n’a pas présenté de propositions ou si les propositions présentées ne sont pas conformes aux objectifs énumérés à l’article R. 212-31, le président du Centre national du cinéma et de l’image animée détermine les engagements de programmation de l’exploitant, après consultation du médiateur du cinéma, conformément à ces objectifs.
