Any national of a Member State of the European Union or of another State party to the Agreement on the European Economic Area who is qualified to carry out all or some of the activities mentioned in article L. 212-1 in accordance with the conditions mentioned in article R. 212-90 and who wishes to establish himself on national territory for this purpose must make a prior declaration to the prefect of the department in which he intends to carry out his activity on a principal basis or to the minister responsible for sports for the activities mentioned in 1° and 2° of article R. 212-91 and for the activity of mountain leader.
However, when the declaration concerns an activity taking place in a specific environment within the meaning of the provisions of article L. 212-7 , the Minister responsible for sports is competent for the activities mentioned in 1° and 2° of article R. 212-91 and for the activity of mountain leader. By decree, he designates the competent prefect for activities other than those mentioned in 1° and 2° of article R. 212-91 and for the activity of mountain leader.
The list of documents required for the declaration of activity and its renewal is set by order of the Minister for Sport.
The Prefect, or the Minister for Sport for the activities mentioned in 1° and 2° of article R. 212-91 and for the activity of mid-mountain guide, checks the application file and acknowledges receipt within one month of receipt if it is complete, or, if necessary, asks the applicant to complete it within one month. Failing this, the application is declared inadmissible.
The declaration is renewed every five years. The Prefect, or the Minister responsible for sport for the activities mentioned in 1° and 2° of article R. 212-91 and for the activity of mountain leader, is informed of any change in any of the information contained therein.
