In the case referred to in 1° of article R. 212-94-1, in which France is the host Member State, the application for a European professional mountain guide card, accompanied by the required supporting documents, the list of which is set by order of the Minister responsible for sports, is sent by the competent authority of the home Member State to the Minister responsible for sports, who gives a ruling.
Within two months of receiving the opinion of the Minister for Sports, the Prefect of the Isère department may decide, in the light of the supporting documents produced :
1° To issue the European professional mountain guide card ;
2° In the event of duly justified doubts, to request additional information from the applicant or the competent authority of the Member State of origin. This information will be provided by the applicant or by the competent authority of the Member State of origin within two weeks;
3° to impose, by reasoned decision, an aptitude test on the applicant, if it considers that there is a substantial difference between the applicant’s professional qualification and the professional qualification required on the national territory, which is not entirely covered by the knowledge, skills and competences acquired by the applicant in the course of full-time or part-time professional experience or lifelong learning. When the application concerns a temporary and occasional provision of services, the aptitude test is organised within one month of the decision;
4° To refuse, by reasoned decision, to issue the European professional mountain guide card, if the applicant does not meet all the requirements. Applicants are informed of the appeal procedures available to them.
The two-month period referred to in the second paragraph may be extended for a period of two weeks by a reasoned decision notified to the applicant. This extension may be renewed once if the safety of the beneficiaries of the services so requires.
If no decision is taken within three months of receipt of the application or if the aptitude test is not organised within one month, the European professional mountain guide card is issued.
If the European professional mountain guide card has been issued on the basis of inaccurate or false information, it may be withdrawn.
In the case of permanent establishment, the European professional mountain guide card is equivalent to a recognition decision.
In the case of temporary and occasional provision of services, the European professional card for mountain guides is issued for a period of twelve months. It is equivalent to an authorisation to practice and replaces the declaration provided for in article R. 212-92.
