The purchaser may award a contract without prior advertising or competitive tendering where, in the cases defined below, either no applications or no tenders have been submitted within the prescribed time limits, or only inadmissible applications as defined in Article R. 2144-7 or unsuitable tenders as defined in Article L. 2152-4 have been submitted, and provided that the initial terms of the contract are not substantially altered:
1° Invitation to tender launched by a contracting authority ;
2° Formalised procedure launched by a contracting entity;
3° A contract meeting a need whose estimated value is below the formalised procedure thresholds;
4° Contracts covered by 3° of article R. 2123-1.
In the cases mentioned in 1° and 2° of this article and in 3° of article R. 2123-1 meeting a need whose estimated value is equal to or greater than the European threshold applicable to these contracts set out in a notice annexed to this code, a report shall be sent to the European Commission if it so requests.
