Article R2122-4 of the French Public procurement code

The purchaser may award a supply contract without prior advertising or competitive tendering for the purpose of:
1° Supplementary deliveries carried out by the initial supplier and intended either for the partial renewal of supplies or installations or for the extension of existing supplies or installations, where a change of supplier would oblige the purchaser to acquire supplies with different technical characteristics resulting in incompatibility or disproportionate technical difficulties in use and maintenance. When such a contract is awarded by a contracting authority, its duration may not exceed, except in duly justified cases, three years, including renewal periods;
2° The purchase of raw materials quoted and bought on the stock exchange.

L’acheteur peut passer un marché de fournitures sans publicité ni mise en concurrence préalables ayant pour objet :
1° Des livraisons complémentaires exécutées par le fournisseur initial et qui sont destinées soit au renouvellement partiel de fournitures ou d’installations, soit à l’extension de fournitures ou d’installations existantes, lorsque le changement de fournisseur obligerait l’acheteur à acquérir des fournitures ayant des caractéristiques techniques différentes entraînant une incompatibilité ou des difficultés techniques d’utilisation et d’entretien disproportionnées. Lorsqu’un tel marché est passé par un pouvoir adjudicateur, sa durée ne peut dépasser, sauf cas dûment justifié, trois ans, périodes de reconduction comprises ;
2° L’achat de matières premières cotées et achetées en bourse.
