If conciliation fails, the mediator shall invite the party that referred the matter to him to state in writing, within a time limit set by the mediator, the subject of his request and the grounds on which it is based. As soon as the mediator receives the request, he will notify it to the other party by registered letter with acknowledgement of receipt or by electronic registered letter within the meaning of article R. 53 of the French Post and Electronic Communications Code. In the absence of an extension decided by the mediator, this party has a period of eight days from the date of receipt of the registered letter in which to submit its observations in writing.
When the mediator has referred the matter to himself or in the event of a referral by a professional or trade union organisation or by the Chairman of the Centre national du cinéma et de l’image animée, the mediator invites the parties concerned to submit their observations within the time limits set out in the previous paragraph.
