Article R2131-28 of the French Public Health Code

The application for authorisation must be drawn up in accordance with a standard dossier, the composition of which is set by the Director General of the Agence de la biomédecine.

This application is sent by the director of the establishment to the Director General of the Agence de la biomédecine by registered post with acknowledgement of receipt, or lodged with the Agence under the same conditions. This application must be signed by the practitioners approved for the activities mentioned in Article R. 2131-22-2.

Applications for authorisation or renewal of authorisation are examined by the Agence de la biomédecine and are the subject of an opinion from the Director General of the competent Regional Health Agency and a decision from the Director General of the Agence de la biomédecine under the conditions laid down in Article R. 2131-13.

The Director General of the Agence de la biomédecine informs the Director General of the relevant Regional Health Agency of authorisations granted or refused, and of decisions relating to the renewal of authorisations.

The Agence de la biomédecine publishes decisions relating to authorisations, renewals, suspensions and withdrawals of these authorisations in the Official Bulletin of the Ministry of Health. It updates the list of authorised establishments and makes it available to the public.

La demande d’autorisation est formulée selon un dossier type dont la composition est fixée par le directeur général de l’Agence de la biomédecine.

Cette demande est adressée par le directeur de l’établissement au directeur général de l’Agence de la biomédecine sous pli recommandé avec demande d’avis de réception ou déposée contre récépissé auprès de l’Agence dans les mêmes conditions. Cette demande est signée par les praticiens agréés pour les activités mentionnées à l’article R. 2131-22-2.

Les demandes d’autorisation ou de renouvellement d’autorisation sont instruites par l’Agence de la biomédecine et font l’objet d’un avis du directeur général de l’agence régionale de santé compétente et d’une décision du directeur général de l’Agence de la biomédecine dans les conditions prévues à l’article R. 2131-13.

Le directeur général de l’Agence de la biomédecine informe le directeur général de l’agence régionale de santé concernée des autorisations accordées ou refusées, ainsi que des décisions relatives au renouvellement des autorisations.

L’Agence de la biomédecine publie au Bulletin officiel du ministère chargé de la santé les décisions relatives aux autorisations, au renouvellement, à la suspension et au retrait de ces autorisations. Elle tient à jour la liste des établissements autorisés et la met à la disposition du public.
