Article R2131-34 of the French Public Health Code

Where breaches of the provisions of this chapter are observed in an establishment authorised to carry out pre-implantation diagnosis pursuant to Article R. 2131-27, the Director General of the Agence de la biomédecine may, at any time, withdraw the authorisation of this establishment after obtaining the opinion of its Steering Committee and informing the Regional Health Agency concerned.

In an emergency, the authorisation may, as a precautionary measure, be suspended for a maximum period of three months after informing the regional health agency.

Before any decision is taken to suspend or withdraw authorisation, the authorisation holder is given formal notice to put an end to these breaches or to present its observations within the time limit set by the Director General of the Agence de la biomédecine.

Lorsque sont constatés dans un établissement autorisé à pratiquer le diagnostic préimplantatoire en application de l’article R. 2131-27 des manquements aux dispositions du présent chapitre, le directeur général de l’Agence de la biomédecine peut, à tout moment, retirer l’autorisation de cet établissement après avis de son conseil d’orientation et information de l’agence régionale de santé concernée.

En cas d’urgence, l’autorisation peut, à titre conservatoire, être suspendue pour une durée maximale de trois mois après information de l’agence régionale de santé.

Avant toute décision de suspension ou de retrait d’autorisation, le titulaire de l’autorisation est mis en demeure de mettre fin à ces manquements ou de présenter ses observations dans le délai imparti par le directeur général de l’Agence de la biomédecine.
