Article R2131-5-5 of the French Public Health Code

Without prejudice to the conditions defined in 1° and 2° of Article L. 6122-2, the granting or renewal of the authorisation, mentioned in Article L. 2131-1, granted to public health establishments and medical biology laboratories to carry out one or more of the biological activities listed in I and II of Article R. 2131-1, is subject to compliance with the rules laid down in this section of this chapter. These rules constitute the establishment conditions and the technical operating conditions provided for in 3° of Article L. 6122-2.

This authorisation is issued to the public health establishment or medical biology laboratory by the Director General of the Regional Health Agency under the conditions laid down in Article L. 2131-1.

For each activity mentioned in the first paragraph of this article, the authorisation may be limited to part of that activity.

Where the health care organisation has several sites, the authorisation specifies the sites where the activities are carried out. When the authorisation is issued to a medical biology laboratory, it specifies the location of the premises reserved for these activities in compliance with the provisions of Article R. 6211-11.

Sans préjudice des conditions définies aux 1° et 2° de l’article L. 6122-2, l’octroi ou le renouvellement de l’autorisation, mentionnée à l’article L. 2131-1, accordée aux établissements publics de santé et aux laboratoires de biologie médicale pour pratiquer une ou plusieurs des activités biologiques figurant au I et au II de l’article R. 2131-1, est subordonné au respect des règles fixées dans la présente section du présent chapitre. Ces règles constituent les conditions d’implantation et les conditions techniques de fonctionnement prévues au 3° de l’article L. 6122-2.

Cette autorisation est délivrée à l’établissement public de santé ou au laboratoire de biologie médicale par le directeur général de l’agence régionale de santé dans les conditions fixées par l’article L. 2131-1.

Pour chaque activité mentionnée au premier alinéa du présent article, l’autorisation peut être limitée à une partie de cette activité.

Lorsque l’établissement de santé comporte plusieurs sites, l’autorisation précise les sites d’exercice des activités. Lorsque l’autorisation est délivrée à un laboratoire de biologie médicale, elle précise le lieu où sont implantés les locaux réservés à ces activités dans le respect des dispositions de l’article R. 6211-11.
