Article R214-155-1 of the French Monetary and Financial Code

The rights in rem referred to in 1° of I of article L. 214-36 are :

1° Ownership, bare ownership and usufruct ;

2° emphyteusis ;

3° easements;

4° The rights of the lessee under a construction lease or a rehabilitation lease;

5° Any real right conferred by a title or by an emphyteutic lease by reason of the occupation of a public domain property belonging to the State, a local authority or a public establishment over the real estate works, constructions and installations built on this property;

6° Other surface rights;

7° Any right under foreign law that is comparable to one of the rights mentioned in 1° to 6°.

Les droits réels mentionnés au 1° du I de l’article L. 214-36 sont :

1° La propriété, la nue-propriété et l’usufruit ;

2° L’emphytéose ;

3° Les servitudes ;

4° Les droits du preneur d’un bail à construction ou d’un bail à réhabilitation ;

5° Tout droit réel conféré par un titre ou par un bail emphytéotique à raison de l’occupation d’une dépendance du domaine public de l’Etat, d’une collectivité territoriale ou d’un établissement public sur les ouvrages, constructions et installations de caractère immobilier réalisés sur cette dépendance ;

6° Les autres droits de superficie ;

7° Tout droit relevant d’un droit étranger et comparable à l’un des droits mentionnés aux 1° à 6°.
