Article R214-36-1 of the French Monetary and Financial Code

A fonds commun de placement à risques may borrow up to 10% of its assets.

This limit is raised to 30% of its assets to enable it to meet, on a temporary basis, requests for redemption of units by the fund’s unitholders or contractual subscription commitments in an entity mentioned in 3° and 4° of II of article R. 214-36.

Un fonds commun de placement à risques peut procéder à des emprunts dans la limite de 10 % de ses actifs.

Cette limite est portée à 30 % de ses actifs pour lui permettre de faire face, à titre temporaire, à des demandes de rachat de parts par les porteurs de l’organisme ou à des engagements contractuels de souscription dans une entité mentionnée aux 3° et 4° du II de l’article R. 214-36.
