The couple or unmarried woman who wishes to offer their embryos for reception must give their written consent, in application of article L. 2141-5, after at least one interview with the multidisciplinary clinical-biological medical team mentioned in article L. 2141-2.
These interviews are used in particular:
1° To inform the two members of the couple or the unmarried woman of the legislative and regulatory provisions relating to the reception of the embryo, and in particular their consequences with regard to filiation;
2° To inform them of the provisions of article L. 2143-2 relating to the access of persons conceived by medically assisted procreation with a third party donor to non-identifying data and to the identity of third party donors, and the need to consent to the communication of this data with a view to offering the embryo for reception;
3° To specify the conditions for prior assessment of the feasibility of the reception of the embryo and the nature of the examinations to be carried out, if they have not already been carried out, under the conditions defined in Article R. 2141-4, in accordance with the rules of good practice defined by the decree provided for in Article L. 2141-1;
4° To inform them that their consent to the reception of the embryo by a third party couple or an unmarried woman implies their consent to the conservation of information relating to their health, as mentioned in Article R. 2141-7;
5° Informing them that their consent must be confirmed in writing after a period of reflection of three months from the signing of the initial consent provided for in Article L. 2141-4, and that the absence of any written revocation of consent within this period constitutes confirmation.
The model for the consent referred to in the first paragraph is laid down by order of the Minister for Health after obtaining the opinion of the Director General of the Agence de la biomédecine.
