The interruption or cessation of activity of an establishment, a health cooperation group or a laboratory authorised to preserve gametes, germ tissue or embryos must not result in the cessation of their preservation.
To this end, any health establishment, body, health cooperation group or laboratory authorised to preserve gametes, germ tissue or embryos must conclude an agreement with another establishment, group or laboratory authorised to carry out the same activity, with a view to the possible movement of these gametes, germ tissue or embryos. This agreement must be sent to the Regional Health Agency prior to the compliance visit provided for in article L. 6122-4.
In this case, the competent regional health agencies and the Agence de la biomédecine must be notified in advance of any gametes, germinal tissue or embryos being moved. If this transfer is not carried out under the agreement provided for in the previous paragraph, it must be authorised by the regional health agency, after obtaining the opinion of the Agence de la biomédecine.
Where circumstances so require, the regional health agency may designate a centre authorised to carry out the same activity to receive the gametes, germ tissue or embryos. It shall inform the Agence de la biomédecine.
