Article R2143-11 of the French Public Health Code

The categories of personal data and information recorded in the processing mentioned in article R. 2143-10 are:

1° With regard to third-party donors:

a) The data relating to their identity mentioned in 3° of article R. 2143-1;

b) The non-identifying data mentioned in 4° of article R. 2143-1 and specified in article R. 2143-12;

c) Data relating to the use of gametes and embryos for medically assisted procreation with a third party donor;

2° Concerning persons born of medically assisted procreation with a third party donor:

a) Data relating to their identity, as mentioned in 3° of article R. 2143-1;

b) Data relating to parentage with the beneficiaries of medically assisted procreation with a third-party donor;

3° With regard to the beneficiaries of medically assisted procreation with a third-party donor:

a) Data relating to their identity, as mentioned in 3° of article R. 2143-1;

b) Data relating to parentage with the person or persons born of medically assisted procreation with a third-party donor;

c) Data enabling a link to be established with the third-party donor or donors.

Les catégories de données à caractère personnel et les informations enregistrées dans le traitement mentionné à l’article R. 2143-10 sont :

1° S’agissant des tiers donneurs :

a) Les données relatives à leur identité mentionnées au 3° de l’article R. 2143-1 ;

b) Les données non identifiantes mentionnées au 4° de l’article R. 2143-1 et précisées à l’article R. 2143-12 ;

c) Les données relatives à l’utilisation des gamètes et des embryons pour la réalisation d’une assistance médicale à la procréation avec tiers donneur ;

2° S’agissant des personnes nées d’une assistance médicale à la procréation avec tiers donneur :

a) Les données relatives à leur identité, telles que mentionnées au 3° de l’article R. 2143-1 ;

b) Les données relatives à la filiation avec les bénéficiaires de l’assistance médicale à la procréation avec tiers donneur ;

3° S’agissant des bénéficiaires d’une assistance médicale à la procréation avec tiers donneur :

a) Les données relatives à leur identité, telles que mentionnées au 3° de l’article R. 2143-1 ;

b) Les données relatives à la filiation avec la ou les personnes nées d’une assistance médicale à la procréation avec tiers donneur ;

c) Les données permettant d’établir un lien avec le ou les tiers donneurs.
