Article R2143-17 of the French Public Health Code

I.-The categories of personal data recorded in the processing mentioned in article R. 2143-16 are:

1° In the case of persons born of medically assisted procreation with a third-party donor:

a) Data relating to their identity, as mentioned in 3° of article R. 2143-1, and their contact details;

b) Data relating to their filiation with the beneficiaries of medically assisted procreation with a third party donor;

c) Data relating to the processing of their request;

2° Concerning the beneficiaries of medically assisted procreation with a third party donor:

a) Data relating to their identity, as mentioned in 3° of article R. 2143-1, and their contact details;

b) Data relating to the donation from which they benefited;

c) Data relating to their filiation with the person or persons born from medically assisted procreation with a third party donor;

3° With regard to third party donors not subject to the provisions of Chapter III of Title IV of Book I of Part Two of the Legislative Part of the present Code at the time of the donation:

a) Data relating to their identity, as mentioned in 3° of Article R. 2143-1, and their contact details;

b) Data making it possible to determine the donor’s status with regard to Chapter III of Title IV of Book I of Part Two of the Legislative Part of this Code at the time of donation;

c) Data relating to the procedures for consenting to the communication of their non-identifying data and data relating to their identity;

d) When the data mentioned in a) is not included in the processing mentioned in Article R. 2143-10, any information that may contribute to the identification of third-party donors, including registration numbers in the national register of natural persons and the national inter-regime register of health insurance beneficiaries.

II.The processing mentioned in Article R. 2143-16 also covers data relating to the identity and non-identifying data mentioned in Article R. 2143-12 of third-party donors subject to the provisions of Chapter III of Title IV of Book I of Part Two of the Legislative Part of the present Code at the time of the donation, processed in response to requests submitted to the Commission for Access to Third-Party Donor Data by Persons Born of Medically Assisted Procreation pursuant to the provisions of Article L. 2143-5.

Article R2143-17

I.-Les catégories de données à caractère personnel enregistrées dans le traitement mentionné à l’article R. 2143-16 sont :

1° S’agissant des personnes nées d’une assistance médicale à la procréation avec tiers donneur :

a) Les données relatives à leur identité, telles que mentionnées au 3° de l’article R. 2143-1, et à leurs coordonnées ;

b) Les données relatives à leur filiation avec les bénéficiaires de l’assistance médicale à la procréation avec tiers donneur ;

c) Les données relatives au traitement de leur demande ;

2° S’agissant des bénéficiaires d’une assistance médicale à la procréation avec tiers donneur :

a) Les données relatives à leur identité, telles que mentionnées au 3° de l’article R. 2143-1, et à leurs coordonnées ;

b) Les données relatives au don dont ils ont bénéficié ;

c) Les données relatives à leur filiation avec la ou les personnes nées d’une assistance médicale à la procréation avec tiers donneur ;

3° S’agissant des tiers donneurs non soumis aux dispositions du chapitre III du titre IV du livre Ier de la deuxième partie de la partie législative du présent code au moment du don :

a) Les données relatives à leur identité, telles que mentionnées au 3° de l’article R. 2143-1, et à leurs coordonnées ;

b) Les données permettant de déterminer le statut du donneur vis-à-vis du chapitre III du titre IV du livre Ier de la deuxième partie de la partie législative du présent code au moment du don ;

c) Les données relatives aux modalités de consentement à la communication de leurs données non identifiantes et des données relatives à leur identité ;

d) Lorsque les données mentionnées au a ne figurent pas dans le traitement mentionné à l’article R. 2143-10, toute information pouvant concourir à l’identification des tiers donneurs, y compris les numéros d’inscription au répertoire national d’identification des personnes physiques et au répertoire national interrégimes des bénéficiaires de l’assurance maladie.

II.-Le traitement mentionné à l’article R. 2143-16 porte également sur les données relatives à l’identité et les données non identifiantes mentionnées à l’article R. 2143-12 des tiers donneurs soumis aux dispositions du chapitre III du titre IV du livre Ier de la deuxième partie de la partie législative du présent code au moment du don, traitées à l’occasion des réponses apportées aux demandes dont la commission d’accès des personnes nées d’une assistance médicale à la procréation aux données des tiers donneurs est saisie en application des dispositions de l’article L. 2143-5.
