Article R2143-6 of the French Public Health Code

As soon as the donation is used, the healthcare organisation or institution shall include the data communicated by the third party donors in the data processing provided for in Article L. 2143-4.

The data is completed after the birth of the child by the collection of the information mentioned in II of article L. 2143-3. To this end, the beneficiaries of medically assisted procreation provide the doctor with data relating to their identity and that of the child. The doctor shall forward the information thus collected to the Agence de la biomédecine.

Dès l’utilisation du don, l’organisme ou l’établissement de santé intègre les données communiquées par les tiers donneurs au traitement de données prévu à l’article L. 2143-4.

Les données sont complétées après la naissance de l’enfant par le recueil des informations mentionnées au II de l’article L. 2143-3. A cette fin, les bénéficiaires de l’assistance médicale à la procréation communiquent au médecin les données relatives à leur identité et à celle de l’enfant. Le médecin transmet les informations ainsi recueillies à l’Agence de la biomédecine.
