In the consultation documents, the purchaser may require tenderers to provide a test report from an accredited conformity assessment body as proof of compliance with the technical specifications, award criteria or contract performance conditions, in accordance with Regulation (EC) No 765/2008 of the European Parliament and of the Council of 9 July 2008 setting out the requirements for accreditation and market surveillance relating to the marketing of products and repealing Council Regulation (EEC) No 339/93, or a certificate issued by such a body. Where it requires a certificate drawn up by an identified assessment body, it will accept a certificate drawn up by an equivalent body.
Where an economic operator does not have access to the certificates or test reports mentioned in the previous paragraph or the possibility of obtaining them within the time limits set by the purchaser, the latter will accept other appropriate means of proof.
