Article R2152-10 of the French Labour Code

For the assessment of the criteria defined in 2° and 3° of article L. 2152-2, professional employers’ organisations are taken into account if they pay a membership fee to a professional employers’ organisation applying for the establishment of its representativeness, in accordance with the rules laid down by the competent body of the applicant organisation, and according to procedures ensuring that member organisations are informed as to the organisation to which the membership fee is paid.

Organisations which, in accordance with the procedures laid down by a decision of the competent body of the applicant organisation, pay a reduced membership fee to take account of membership during the year or for any other reason provided for in the aforementioned decision, are also counted as members, provided that this reduction does not exceed by half the membership fee due in application of the rules mentioned in the previous paragraph.

Pour l’appréciation des critères définis aux 2° et 3° de l’article L. 2152-2, sont prises en compte les organisations professionnelles d’employeurs dès lors qu’elles versent une cotisation à une organisation professionnelle d’employeurs candidate à l’établissement de sa représentativité, conformément aux règles fixées par l’organe compétent de l’organisation candidate, et selon des modalités assurant l’information des organisations adhérentes quant à l’organisation destinataire de la cotisation.

Sont également prises en compte comme adhérentes les organisations qui, selon les modalités fixées par une délibération de l’organe compétent de l’organisation candidate, s’acquittent d’une cotisation dont le montant est réduit, pour tenir compte d’une adhésion en cours d’année ou de tout autre motif prévu par la délibération précitée, sous réserve que cette réduction n’excède pas de moitié la cotisation due en application des règles mentionnées à l’alinéa précédent.
