Article R2161-18 of the French Public procurement code

The procedure with negotiation may take place in successive phases so as to reduce the number of tenders to be negotiated by applying the award criteria defined in the consultation documents. The contracting authority shall indicate in one of these documents whether it will make use of this possibility.
In the final negotiation phase, the number of tenders remaining to be negotiated must be sufficient to ensure genuine competition, provided that there is a sufficient number of tenders which meet the required conditions.

La procédure avec négociation peut se dérouler en phases successives de manière à réduire le nombre d’offres à négocier en appliquant les critères d’attribution définis dans les documents de la consultation. Le pouvoir adjudicateur indique, dans l’un de ces documents, s’il fera usage de cette possibilité.
Dans la phase finale de négociation, le nombre d’offres restant à négocier doit être suffisant pour assurer une concurrence réelle, pour autant qu’il y ait un nombre suffisant d’offres remplissant les conditions requises.
