Article R2171-23 of the French Public procurement code

If the holder of a global contract is not itself a small or medium-sized enterprise or a craftsman, the minimum proportion that it undertakes to entrust, directly or indirectly, to small and medium-sized enterprises or craftsmen, pursuant to Article L. 2171-8, is set at 10% of the estimated value of the contract, except where the economic structure of the sector concerned does not allow this.

The rate mentioned in the first paragraph may be modified by decree.

Si le titulaire d’un marché global n’est pas lui-même une petite ou moyenne entreprise ou un artisan, la part minimale qu’il s’engage à confier, directement ou indirectement, à des petites et moyennes entreprises ou à des artisans, en application de l’article L. 2171-8, est fixée à 10 % du montant prévisionnel du marché, sauf lorsque la structure économique du secteur concerné ne le permet pas.


Le taux mentionné au premier alinéa peut être modifié par décret.
