Article R2184-8 of the French Public procurement code

The contracting entity shall also keep the following information:
1° The reasons for awarding a contract without prior advertising or competitive tendering;
2° The reasons why it did not allocate the contract;
3° The reasons why it required a minimum annual turnover in excess of the ceiling set in article R. 2142-7, where these have not been indicated in the consultation documents;
4° A description of the appropriate measures taken to ensure that competition has not been distorted by prior studies and exchanges with economic operators or by the participation of an economic operator in the preparation of the contract pursuant to Articles R. 2111-1 and R. 2111-2;
5° The reasons for requesting the use of means of communication other than electronic means for the transmission of tenders.

L’entité adjudicatrice conserve également les informations suivantes :
1° Les motifs de la passation d’un marché sans publicité ni mise en concurrence préalables ;
2° Les motifs pour lesquels elle n’a pas alloti le marché ;
3° Les raisons pour lesquelles elle a exigé un chiffre d’affaires annuel minimal supérieur au plafond fixé à l’article R. 2142-7, lorsque celles-ci n’ont pas été indiquées dans les documents de la consultation ;
4° La description des mesures appropriées qu’elle a prises pour s’assurer que la concurrence n’a pas été faussée par des études et échanges préalables avec des opérateurs économiques ou par la participation d’un opérateur économique à la préparation du marché en application des articles R. 2111-1 et R. 2111-2 ;
5° Les raisons pour lesquelles elle a sollicité l’utilisation de moyens de communication autres que les moyens électroniques pour la transmission des offres.
